บทคัดย่อ

           มาตรการทางกฎหมายในการอนุรักษ์โบราณสถาน เป็นการบังคับใช้กฎหมายเพื่อการอนุรักษ์โบราณสถาน ให้คงไว้ตามสภาพเดิมเท่าที่เป็นอยู่และป้องกันมิให้เสียหายต่อไป มาตรการดังกล่าวกำหนดไว้ในบทบัญญัติรัฐธรรมนูญแห่งราชอาณาจักรไทย พุทธศักราช 2560 และพระราชบัญญัติหลายฉบับ ซึ่งผู้ใช้กฎหมายสามารถนำมาตรการของกฎหมายแต่ละฉบับให้มีผลบังคับใช้ได้ อย่างไรก็ตาม องค์กรปกครองส่วนท้องถิ่นนับเป็นหน่วยงานสำคัญในฐานะเจ้าของพื้นที่ที่จะมีความรู้ความเข้าใจเกี่ยวกับโบราณสถานและคุณค่าในพื้นที่ของตนอย่างดี ย่อมกำหนดแนวทางในการปฏิบัติหรือห้ามปฏิบัติเพื่อการรักษาโบราณสถานของตนได้อย่างเหมาะสม ทั้งยังสามารถกำกับดูแลได้อย่างใกล้ชิด จึงนับเป็นหน่วยงานสำคัญที่จะตรากฎหมายเพื่อการอนุรักษ์โบราณสถานได้อย่างมีประสิทธิภาพ ดังเช่นกรณี “บ้านเขียว” อาคารบอมเบย์ เบอร์มา ที่มีอายุยืนยาวมาถึง 131 ปี ณ วันนี้ก็จะมีสภาพที่เก่าแก่ผุพังและเป็นที่คุ้นตาและคุ้นชินของคนในชุมชน ไม่มีเหตุปัจจัยใดที่จะจูงใจให้มีการค้นหาเรื่องราวที่สะท้อนถึงวิถีชีวิตและความน่าภาคภูมิใจของเมืองแพร่เมืองแห่งไม้สักทอง ไม่มีแรงจูงใจใดที่จะให้บอกเล่าสืบต่อไปถึงรุ่นลูกหลาน บ้านเขียวที่มีประวัติความเป็นมาที่น่าภาคภูมิใจที่เมืองแพร่เป็นเมืองเอกของไม้สัก และศิลปะอันงดงามของอาคารบอมเบย์ เบอร์มา ตลอดถึงวิถีชีวิตของผู้คนในเมืองแพร่ที่มีทั้งเจ้านายของเมืองแพร่ คนต่างชาติ และคนเมืองแพร่เจ้าของถิ่น ซึ่งต่างก็มีส่วนในอาชีพการทำไม้ร่วมกัน บ้านเขียวจึงตั้งอยู่อย่างโดดเดี่ยวริมน้ำยม ไม่สามารถสะท้อนถึงความรุ่งเรืองแต่เก่าก่อน ไม่สะท้อนถึงความวิจิตรพิสดารของสถาปัตยกรรมแห่งยุคสมัยนั้น เมื่อสำนักบริหารพื้นที่อนุรักษ์ที่ 13 มีความต้องการที่จะปรับปรุงอาคารเพื่อให้ทันสมัย และใช้ประโยชน์ได้ จึงสามารถดำเนินการตามขั้นตอนของทางราชการได้อย่างง่ายดาย ไม่ต้องใช้หลักวิชาการเพราะอาคารแห่งนี้ก็ไม่ได้ขึ้นทะเบียนเป็นโบราณสถาน ต่อเมื่อเป็นข่าวจึงกลายเป็นเรื่องน่าเสียดายของทุกฝ่าย

Abstract

             Legal measures for the preservation of historic sites is the enforcement of the law for the preservation of historic sites to maintain the same condition as it is and prevent further damage. Such measures are stipulated in the Constitution of the Kingdom of Thailand B.E. 2560 and several laws. The law users can apply the measures of each law to take effect. However, the local government is an important agency as the owner of the area to have a good knowledge and understanding of the historic sites and their values in their area. Would prescribe guidelines for treating or prohibiting appropriate practices for the preservation of their historic sites and also able to monitor closely It is therefore an important agency to enact laws for the preservation of ancient sites effectively. For example, in the case of "Baan Kheaw", the Bombay Burma building, which is 131 years today, is pristine, decaying, and is familiar and familiar to the community.
